Welcome to Nestides. These Terms of Use govern your use of the Nestides website, the TidePress WordPress plugin, and any related services, software, APIs, applications, mobile apps, content, or features that we make available through Nestides.
By accessing or using our website, creating an account, using TidePress, or using any related Nestides services, you agree to these Terms of Use. If you do not agree, do not use the website, plugin, or services.
1. Who We Are
Nestides provides website and plugin-based access to tide-related information and related services. TidePress is a WordPress plugin that connects to the Nestides service in order to retrieve and display tide information on supported websites.
2. External Service Dependency
TidePress is not a fully standalone plugin. Certain features and functionality depend on the Nestides service, including service access, entitlement checks, usage tracking, account-related functions, and tide data retrieval or presentation.
By using TidePress, you understand and agree that the plugin may communicate with Nestides-operated endpoints and services in order to function as intended.
3. NOAA Data Source and Non-Endorsement
Nestides and TidePress use tide prediction data derived from NOAA Tides & Currents / NOAA Tide Predictions and related NOAA data services where applicable. NOAA, the National Ocean Service, and the Center for Operational Oceanographic Products and Services are not affiliated with, do not endorse, and do not sponsor Nestides, TidePress, or any website using the plugin or service.
Use of NOAA-derived data by Nestides or TidePress does not imply any partnership, certification, approval, or official status. Nestides and TidePress are independent products and services. NOAA names, seals, logos, and visual identifiers are not used to imply endorsement, sponsorship, or affiliation.
Tide-related information made available through Nestides or TidePress may be reformatted, cached, combined with other data, or presented through our own software and interfaces. It should not be represented as official NOAA material.
4. Informational Use Only
Tide information, charts, tables, and related outputs made available through Nestides or TidePress are provided for general informational purposes only.
They are not guaranteed to be complete, current, error-free, uninterrupted, or suitable for navigation, emergency decision-making, safety-critical planning, legal compliance, or any mission-critical use. Conditions on the water and in the real world may differ from predicted or displayed information.
You are solely responsible for determining whether the information is appropriate for your particular use case. Where needed, you should consult official NOAA resources and any other appropriate official or local sources directly.
5. No Warranty
Nestides, TidePress, and all related content and services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or reliability.
We do not guarantee that the service will always be available, that data will always be accurate or current, or that the plugin or service will operate without interruption or error.
6. Limitation of Liability
To the fullest extent permitted by law, Nestides and its owners, operators, affiliates, contractors, service providers, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, business opportunity, goodwill, or business interruption arising out of or related to the use of, or inability to use, the website, plugin, service, data, or related materials.
To the fullest extent permitted by law, our total liability for any claim arising from or relating to the website, plugin, or services will not exceed the amount you paid to Nestides for the applicable service during the twelve (12) months preceding the event giving rise to the claim, or fifty U.S. dollars (US $50), whichever is greater.
7. User Responsibilities
You agree to use Nestides and TidePress lawfully and responsibly. You may not:
- use the service in violation of any law or regulation
- attempt to interfere with, disrupt, or overload our systems
- attempt to bypass usage limits, account controls, or access restrictions
- misrepresent NOAA or any third-party source as endorsing your website, product, or business
- present Nestides or TidePress outputs as official NOAA publications or government-issued content
- use the service in any way that creates excessive automated load, abuse, scraping, or misuse beyond normal intended operation
You are responsible for the content, configuration, and operation of your own website and for how you present tide information to your users.
8. Accounts, Plans, Billing, and Usage
Some Nestides features may require an account, installation registration, API credentials, or an active plan. Free, demo, paid, or usage-limited access may be subject to quotas, service rules, or technical controls.
If you purchase a paid plan, you agree to provide accurate billing information and authorize charges according to the pricing and billing terms presented at checkout.
We may modify plan features, quotas, and pricing in the future. Material pricing changes will apply prospectively, not retroactively, unless otherwise stated.
Failure to maintain a valid payment method or active subscription may result in loss of access to paid features.
9. Service Changes and Availability
We may modify, suspend, limit, or discontinue any portion of Nestides, TidePress-connected services, pricing, plans, APIs, or features at any time, with or without notice, subject to applicable law.
We are not liable for downtime, outages, upstream data interruptions, service changes by third-party providers, or reasonable maintenance windows.
10. Intellectual Property
Nestides, TidePress, and related branding, software, text, layout, and service materials are owned by or licensed to us, except for third-party marks, names, and publicly sourced data that remain the property of their respective owners.
WordPress is a trademark of the WordPress Foundation. NOAA and related agency names are the property of their respective owners. Reference to those names is for factual identification only and does not imply affiliation or endorsement.

12. Termination
We may suspend or terminate access to the website, plugin-connected service, accounts, or related features if we reasonably believe you have violated these Terms, abused the service, created security risk, or failed to comply with billing obligations.
